Depends, on the original channel 'Court TV', there were "real" court cases, such as the OJ trial. But shows like Judge Judy are more dramatized, and the cases are more often than not civil and not criminal.

To some extent, the IQ of the participants! Actually, the rulings of TV court are legal and binding. Only the demeanor of the proceedings is different! Remember TV court is all civil action, not criminal. The big difference is in the payoff. In real court, you can be ordered to pay but there is no court system in place to actually follow through in collecting what is owed you. On TV, what we viewers are not privy to is the deal that is made with all parties appearing on the show. I'd bet the winners on the show get paid what is due them by the show. Like a game show, they win the big prize. The losers (at the very least) don't actually have to come up with any money. They may even get paid "consolation" prize money. Game show, right? That is how show biz works and every participant is entitled to be paid for entertaining a nationally sponsored TV audience. Win, win.
