You should be able to win a settlement in court if it really was their fault. Hopefully, you have uninsured motorist coverage, in which case I think your insurance company will help you financially and go to court for you. Ask an insurance agent for more information. (I personally like State Farm, but that mightbe because my dad is an agent. :-) )

In the UK - the Motor Insurers Bureau will pay compensation for your personal injury and vehicle damage if a driver of the vehicle who caused the accident was uninsured or untraced. It is best to use a specialist RTA solicitor to help you make this type of claim. Generally - your solicitor's legal costs can also be claimed from the MIB. See the related link entitled Motor Insurers Bureau below to go direct to the MIB website.

What if you were in a car accident and it was not your fault but you had no collision?

If the police report says the other driver was at fault, try to recover from his or her insurance company. If you don't have collision coverage, you can't collect from your insurance company.

What does the term 'insurance collision' mean?

Insurance collision is a form of automobile insurance that covers physical damage. In most situations the insurer pays for the insured injuries, damage to the vehicle of the insured, and if the insured is at fault it pays for the damage to the other vehicle, and the other driver.

No, if you have the right coverage (collision) your company will still pay for your car.

What happens if your car gets totaled by another driver in collision accident?

You get the Traffic Collision Report. You find out who was at fault. You get the other driver's insurance information. You file a claim with his insurance company. Using an attorney to represent you helps to avoid you suffering through the process yourself.

If you have PLPD and are involved in an accident does their insurance cover your car?

If the other party has insurance then their "property damage" coverage should cover damage to your vehicle. If you happen to be at fault or there is some question as to who is at fault then it might be hard to collect from their insurance company. Only if the other party is at fault. If you have collision insurance, you can file the claim with your own agent. Then you will be paid for your damages, less your deductible, and when your company collects from the other company you will also get your deductible. If you do not have collision, you will have to file your claim directly with the at-fault driver's insurance. If the company denies your claim (and unless there is very compelling evidence that their client was at fault, they will), you will have to sue the driver. Then, IF YOU WIN the lawsuit, their insurance will pay.

If you do not have insurance and someone hit you in the back with insurance can you have your cost paid for in Louisiana?

While you may receive a traffic citation for driving without insurance, the individual who is responsible for the collision should pay for damages. If the other driver was found at fault, he/she should pay for damages, just as you should pay for damages that YOU cause. If the police investigated the collision and found that you were both at fault, you will probably have to pay your own damages. If you did not have the police investigate the collision, you may be stuck with the damages unless the other driver agrees to pay and admitted fault.
