like the title says, i was side swiped on the right back door of my 2013 charger by a 2013 Chevrolet Equinox. It was at a 4 way stop sign and i stopped like a normal driver and everything. When i was about 90% across the intersection and other car failed to yield and hit me on the right side. I told her either she pays for the damages in cash or i call the police and we settle this through her insurance. So Insurance it was. now after the 1 month long of her insurance telling me to do all this paper work and going to places to get my car inspected they decide to close my claim and stating they are not gonna pay me anything. why? because the police never issued the other driver a ticket for failing to yield at a stop sign. now two and a half months later i got my insurance involved and fighting with their insurance and supposedly they are going to fix it. My car is not badly damaged the door works fine but its very dented. so i have 3 estimates which i do NOT want to pay out of my pocket because its not my fault. highest estimate is 1950$ and the lowest is 1000$. I need help on what to do. I was told to do a Small Courts Claim and sue the other driver. any suggestion, please?
You can claim whatever you want. You'll get what the insurance adjuster gets you to agree to. You'll get nothing if the driver was indigent.
yes because there might be a drunk/reckless driver and you need insurance if you're in a crash to cover damages
Police and insurance companies.
In order to file a car crash claim you must have car insurance. Call your car insurance provider and give them the details of the accident, such as number of vehicles involved, make and models of all cars, passengers and their injuries. You may also have to provide a police report.
If you are injured in a crash, regardless who is at fault you may claimIf you are the at fault driver and injured the insurance for the car you are driving may or may NOT cover your injuries. If you are not the owner of either auto you may not claim for damage to either vehicle, only the owner of the vehicle may do that.
There are several options in filing a claim for a fatal car crash. You might want to file for life insurance provisions. You might want to file for the replacement of the automobile. Your test option will be to consult an attorney.
The owner of the property (if he can), the police and his insurance company.
... without any auto insurance and/or a suspended license. There may not be any way to gain compensation if it was the other driver's fault.
you'll have to pay for your own car, but you could always take the person to court.
You may need to check with the insurance company. Most companies will cover accidents that happen when a car is borrowed by a licensed driver.
Driving instructor insurance is designed to protect both the instructor and the student in the event of a crash. For student driver companies, this specific insurance is required by the law.
In most states, if you let someone borrow your vehicle and they end up crashing it, YOU are responsible for the crash, not the person driving it. Why? Because the vehicle is registered under YOUR name. If you have insurance (and hopefully you do) then your insurance has YOUR car information on it, not the driver's. If you don't, you are found at charge legally because you don't have insurance and that's committing a crime. You will be held responsible especially if they are not on your insurance policy. Car insurance covers the vehicle NOT the driver. You can get upset, but only get upset with yourself because you lent your car to someone that is not included as a driver in your insurance. Be careful and this goes with anyone borrowing your vehicle because in the end, you are liable because that's your insurance and car, not theirs. And please file the claim even if you weren't the one operating the vehicle. You can try to sue the person that drove your car, but most likely, you will not win the case depending on the state you live in. If you lie to your insurance company, that's a fraud so if you don't want to do the time, don't commit that crime. Take what your insurance gives you and learn from this mistake.
