Can a cosigner take the car away from the borrower if he is in default and the cosigner has a key and is paying the payments?

Bill, ONLY if the co-signor is listed ON THE TITLE as CO-OWNER. Co-signors only responsibliity is to make the notes if the signor doesnt. Signor is just USING co-signors creditworthiness.

Is a cosigner still responsible if the first party filed bankruptcy but reaffirmed the car loan?

The company wants their money so if the primary doesnt pay then the cosigner must. Their is no way of getting around this. Bankruptcy should be outlawed. If you cant afford things dont take on the debt.

Does the co borrower have any legal options to recoup losses against the other co borrower when they default and they have to sell the car?

Nope, when you cosign the bank doesnt care who the money comes from. If the money doesnt come in your both equaly at fault.

If you are the primary cosigner on a car and your son is the secondary cosigner can he legally have the car voluntarily repossessed without your consent?

well, if you want the loan AND the car, go get it. Tell the bank that you will keep the car.The bank really doesnt want the car, they want money.Otherwise, the bank will let him give it up if he cant pay. THE co-signor is the one with GOOD credit. If the signor didnt need help getting the loan, there would be no "co" signor.

Can you lose your home for co-signing a student loan?

There is a potential that you could lose your house but that would be very late in the collection process. When you co-sign a loan (doesnt matter if it is a student loan or otherwise) you are assuming FULL responsibility for the obligations of the loan (including payments due as a result of default and late payments) in the event that the primary borrower defaults. The creditors have the option to come after you and it is possible they would go after your house.

Does a co-owner of a vehicle become primary owner upon the death of the primary owner or is the estate of the decedent the new primary owner?

In the state that I live in (IN) as long as the co owner is on the title of the van then the cowner can take possesion upon death(bc he\she already owns it) That way it doesnt have to go through probate and such. We just went through this prob with my mother-in-law and my wife. We have my mother and law's van now. I hope this helps you.
