Not a good situation to be in. If the claim is more than the provided coverage, you are still liable, however, when your insurance co. settles if they execute a Release of all claims, relieving you from liability, you should in a good shape.

If the insurance policy lapses after a claim has been submitted for a minor accident will it affect the claim processing?

The claims department will be concerned only with the status of the policy at the moment of the accident. Other than that, it will not come into play. Any delay would be very minor (as long as it takes someone in the coverage dpt to determine that there was coverage on the date of loss). However, if the insurance was lapsed on the day of the accident, this will, of course, cause there to be no coverage for the accident.

How important is having a witness to an accident affect a claim of workers compensation?

Having a witness will always assist in making a claim for workers compensation, but it is not essential. In the UK - if an accident at work occurs an entry should be made by your employer of the accident circumstances. If the accident was serious or required more than 3 days off work - the Health and Safety executive should be notified by your employer who should investigate the accident circumstances. Your lawyer can access these documents which will assist your claim. For more details on how to show your employer is at fault see the attached link.

If you had an accident with no other cars involved and filed a claim to insurance with no police report do you have to report this accident to the new company if you get different insurance?

If you don't the new insurance company can cancel your coverage and possibly not cover any of YOUR losses. They might also consider it to be fraud. Any accident less than $750 isn't chargeable, but if you filled a claim with another insurance company your new company would found out even if you don't tell them, when they run your MVR which shows your tickets and previous insurance companies and claim paid.
