It is normally very difficult to provide evidence in these matters ,unless there was or is a live 3rd witness who could testify before the court under strict oath,although there is no guarantee that the Courts will accept this alibi-unless in the case of a joint business venture-bank account-or property with the deceased.

Verbal contracts can be enforced. Particularly if one of the parties has relied on the contract to their detriment. It is usually more difficult to enforce and under the statute of frauds, some types of contracts must be in writing to enforce them. The biggest example would be purchase of real property (land).
