The 8GB iPod Touch is a second generation model (3rd generation are 32 and 64 GB models). All the 2nd and 3rd generation iPod Touch models will be able to run iOS4 but because they do not have suitable hardware they will not be able to use all the new features. For example, multitasking, custom wallpaper, and Bluetooth keyboard support are available only with the third-generation iPod touch (32GB and 64GB models from late 2009).

There is no way to use an iOS4 required app on an OS 3.1.3 on an iPhone. You must upgrade to iOS4 (which, by the way, is now free) to use an iOS4 required app.
When you plug in your iPod to your computer or laptop with the connector provided when you purchase the iPod. It should prompt you that there is a newer version available for your iPod, before you update it make sure you back everything up becuase it will restore your iPod and you wil lose everything but if you back it up you can sync it all back on to your iPod.
Check that you have the latest version of the iPod Touch software. The latest version of your software fixes any bugs that prevent apps from opening or spontaneously closing. If you have the 3.0 software, very few apps still are not capable for that software, and will never stop closing out. If you have the iOS4, then check to see that the app works with iOS4. Most apps should have been updated within the couple weeks of the release of the iPhone 4. Also, try redownloading the apps, which may help.
