Shortly, after Robert E. Lee surrendered, Davis was arrested and taken prisoner, and was imprisoned at Fort Monroe. A grand jury indicted him for treason, and he was held in prison for two years awaiting trial.
Horace Greeley and other northern men became his bondsmen in 1867, and he was released on bail. He was never tried.
