If we had known how harmful tobacco was in the days when people first began to use it, I believe that cigarettes too would be prohibited. As it is, it is useless to bolt the stable door once the horse has escaped! One can only hope to get people off cigarettes by gradual legal restrictions as to where they can safely smoke, by banning advertising and by education and persuasion.
Force of habit plays a big role. When smoking tobacco became common, people didn't know how dangerous it was, and before people realized that the use had become too embedded in the structure of the society for it to be easily kicked out.
Also keep in mind that MJ and cigarettes work in quite different ways.
Cigarettes are long-term dangerous, but apart from the fire hazard not immediately dangerous. There are plenty of things that can be done where smoking a cigarrette doesn't add any danger.
MJ OTOH will immediately lengthen your reaction time and change your perception of the world, which is a bad thing in many situations - like driving for instance.
Eventually though, MJ usage may come to be regulated similar to how alcohol usage is regulated.

If you are smoking marijuana in it, or marijuana as ever been smoked in it (residue present) then it is illegal drug paraphernalia. You can ship legal products to your house unless some local law prohibits. You can not legally ship illegal drug paraphernalia to your house.

I think they should both be legal but carry the same rules and consequences. Not driving while drunk or high. I am diabetic now and can't really drink so it would be nice to light one up legally once in a while.

Marijuana is an illegal drug. It is illegal for a reason. Is is especially inappropriate to use marijuana (or any unprescribed drug or alcohol, for that matter) while you are pregnant, and such use could be grounds for a charge of child abuse.
