The fee owner should pay the taxes or the land will be siezed by the town for non-payment of property taxes. Property tax liens never go away and interest accumulates. If you're going to eventually receive the land then pay the property taxes. Maybe the life tenant can't afford them.

Is a life tenancy exempt from paying rent?

Yes. A life tenant has been granted the use and possession of the property for the duration of their natural life. You cannot require them to pay rent. Life tenants have certain financial obligations (insurance, taxes, upkeep, utilities) that vary from state to state. You need to check the laws in your state.

It depends on who you mean by "us". If your mother refuses to give you property that is legally yours, contact the police. If it is jointly owned with your mother, you may need to file a lawsuit to have the property divided.

In the state of VA if property is sold for unpaid taxes does this dissolve the life estate?

Generally, property taxes owed to the town take priority. As the life tenant you should have paid the property taxes if you wanted to remain in possession of the property. You could pay the back taxes, interest and costs and redeem the property within the statutory period of redemption. However, if the taxes remain unpaid the land can be successfully taken and the life estate would be wiped out.You should consult a local real estate attorney to determine if you have a right of redemption.

Can a tenancy in common apply when the property is owned jointly?

The term "joint tenancy" should be reserved for a joint tenancy with the right of survivorship. Although many sources refer to tenants in common as a form of joint ownership that is a misuse of the term and is misleading. Joint tenancy and tenancy in common are properly referred to as different forms of co-ownership or concurrent ownership. If two people acquired the property as joint tenants with the right of survivorship and one dies their interest automatically passes to the surviving joint tenant and the property bypasses probate. A properly drafted joint tenancy cannot be changed as to the survivorship rights of the co-owner when one owner dies. A joint owner cannot leave their interest in the property by their will to any other person.A co-owner who owns property as a joint tenant can break that tenancy and convert it to a tenancy-in-common during life by different methods in different states. In some states a statement can be recorded in the land records declaring the co-owner wants to dissolve the joint tenancy. In other states the co-owner must convey their interest to a straw and the straw conveys it back free of the joint tenancy. A joint tenant can convey their interest to another person during life and the result will be a tenancy in common. When two people own property as tenants-in-common, when one dies their half interest will pass to their heirs by their will or by the state laws of intestacy if there is no will.

Is the life estate terminated if someone moves away from the property and stopped paying taxes for the past three years?

It depends upon the laws of your state. Usually, a "life estate" means exactly that - the grantee has the privilege of occupying or using the property for the remainder of their LIFE. Much depends on how the life estate was granted and worded. Read the wording. Are they required to maintain the property - pay the taxes on the property - etc - etc.? REGARDING THE UNPAID TAXES: If the grantee abandoned the property and ceased paying taxes on it - the grantor(s) actually owning the property had better be paying the taxes or it could be sold at a tax auction for the unpaid tax lien.

If owner does not live on the property but a life tenant does who pays taxes?

Property taxes are the responsibility of the owner. The owner may make arrangements to have someone else pay instead, but ultimately if the taxes are not paid it will be the owner who suffers when the property is sold at auction.
