The case is sent back to the lower court to be re-tried.
The case is re-tried, or perhaps (at the option of the prosecution) the charges may be dropped or reduced.
Only the prosecutor, the defendant, respondant, or their attorney(s) can appeal the findings of the trial court to the Court of Appeals.
A civil or criminal court can handle a case like that , it would most likely be in criminal court and if they were unable to take the case it would handed up to a court like the state supreme court after it was tried in a lower court.
Example: Justice Of The Peace Court is lower than Municipal COurt. Municipal Court is lower than Circuit Court. Circuit Court is lower thatn Appeals COurt. Appeals Court is lower than Supeme Court. Etc. Etc.). Got the idea?
A case is tried in court.
An appeal will reexamine the evidence and the argument made.
