In March of 1776, prior to the Declaration of Independence, South Carolina created an individual constitution to provide a governing body during the time of rebellion. The Constitution of 1776 established the former colony's first independent government. In this document, the South Carolina General Assembly discusses its grievances with Great Britain and outlines its new government. It is not for certain who was the architect of this document.

The Fundamental Constitution of Carolina was written by John Lock in 1669. It replaced the Charter of Carolina and the Concessions and Agreements of the Lords Proprietors of the Province of Carolina.
Some notable tolerationists are Roger Williams, who founded the colony of Rhode Island, John Locke who drafted the Fundamental Constitutions of Carolina, and William Penn who drew up the constitution of Pennsylvania.
