Technically, Spider Man is a comic book super hero, belonging to the Marvel comics. But since the Disney company bought out Marvel last year, that would mean that Disney now owns Spider Man. But that does not necessarily make him a "Disney character," since he was created long before Disney "owned" him.
Scarlet Witch has been portrayed as both a hero and a villain in different comic book storylines. She started off as a villain in the Marvel Universe, but has also been a member of the Avengers and fought on the side of the heroes.
