New Hampshire RSA 153:5 prohibits the state fire marshal from adopting any state fire codes that "require automatic suppressant or sprinkler systems in detached one- or 2-family dwelling units in a structure used only for residential purposes..." However, state law also allows municipalities to adopt their own codes, subject to state approval, and provided that they are no less restrictive than state codes. RSA 674:36(IV) does, on the other hand, prohibit a municipal planning board from requiring or adopting "any regulation requiring, the installation of a fire suppression sprinkler system in proposed one- or 2-family residences as a condition of approval for a local permit." (Acts of 2011:203(1), eff July 1, 2011)
