This was a very interesting and complicated election. It was the first election in which the Southern states that had seceded were able to vote in a more or less normal way. The electoral vote was very close and the credentials of the electors from South Carolina, Louisiana and Florida were challenged and could not be certified, as was also the case with one elector from Oregon. The disputed votes determined the outcome of election. A bi-partisan commission of 5 Congressmen, 5 Senators and 5 Supreme Court Justices was chosen to decide the question. The Congressmen and Senators were equally divided by party as a group 3-2 and 2-3 and since all voted the party line , the Justices decided the election and gave all the disputed votes to Hayes who won by one vote. The loser, Tilden won the popular vote and had he pushed for it, his supporters might have disputed the election for a long time, but Tilden conceded, believing the country would suffer from any more uncertainty about the next president.
