A law was passed in 1998 that has made it even more difficult to discharge a student loan in bankruptcy. It is incredibly difficult to discharge a loan in this way, and the only approach is to convince a court that repaying the loan would create a severe hardship for you. You would have a better chance of cancelling the loans or postponing payments through forebearance or deferrment.
If the student loan is a federal loan and not a private loan then the answer is no. Federal student loans can not be included in bankruptcy, you will always be responsible for repayment of FEDERAL student loans.
See http://www.finaid.org/questions/bankruptcy.phtml for the answer.
It's my understanding that student loans are not discharged by bankruptcy any longer. YOu should check this, though
no it will stay with you forever like student loans
Gov't insured or Guaranteed loans are not dischargable.
I believe that student loans are a category of debt that is not dischargable in bankruptcy. The bankruptcy will show up on any credit reports, and you may subsequently be unable to et additional loans. I filed for bankrupcy in 1998. I was able to obtain Student Loans despite the bankruptcy in 1999-2000. My past credit history was not considered when determining my student loan application.
I didn't get your question. Are you trying to ask if you can able to file bankruptcy again even though you had filed previously one? As far as i know, Student loans won't discharge in bankruptcy. It's better consult this from the bankruptcy advisers.
Student loans are exempt from bankruptcy as are IRS debts
You report all assets and all liabilities. However, government insured or backed student loans are NOT dischargeable.
Govt insured or guaranteed loans are NOT able to be discharged in BK.
While in general you should always follow your attorney's advice, you may wish a second opinion from another attorney this time. A bankruptcy does not get you out of student loans. If you were going to lose your income tax refund to the student loan people, then even after bankruptcy you still will.
Gov't backed student loans are exempt from BKruptcy....they will come after you thru tax refunds or garnishment.
