It could be constituted as kidnapping. You could be arrested for kidnapping, attempted kidnapping, aiding and abetting the delinquency of a minor etc. etc. Get the parents to sign a document saying it is okay
The charge of simple assault is the same whether you are a minor or an adult. There are no "special" offense charges for minors. The only difference is in how you are handled by the legal system. As for the punishment - there is no way to know. It is completely dependent on the seriousness of the offense, and what your past history might be.
Assuming the minor is your child, and you are still married (therefore, no custody settlement) then no, it would not be considered kidnapping.

You're talking serious stuff. Kidnapping is a v-e-r-y serious offense whether you're a juvenile or an adult. You will not get a slap on the wrist for it. At the very least you're looking at some serious time in a juvenile facility and if they try you as an adult, possibly time in the state penitientiary.
