What is the reason. IF the child is in any danger or the sort then the parent has every right. If it is just a control issue then all the grandparents could do is be the bigger people and see what it is that will make the contoller happy. There is not legality of visitation with grandparents unless lets say their child passed away and the only way they can see the child is through the in-law then they can try to force visitation.... This can be for a myriad of reasons. If you are the grandparents, you need to accept the parent's decision as being best for the child, while remaining open to the possibility that the child will find you once he/she is older. Alternatively, ask the parent what they need for you to have visits. Then, follow the rules without argument or by amending them when the parents are not present. If you want to do something, ask. Then, do exactly as the parent wishes. Sometimes there are other issues--physical or verbal abuse, Alcoholism, driving without child seats, etc. that the parent sees as unsafe for the child, and those are hard to overcome. Suing or otherwise forcing visitation on the parents does not bode well for future family relationships.

Funny you should ask. I have joint rights and responsibility. My two teenage daughters lived with me their entire life until 2008, May. I have since been in court with the father and have asked the Judge to speak with my daughters. They refuse to see me every time I ask. They refuse to talk with me on the phone, via e-mail or text. They don't acknowledge me at all. Under Florida Law, the teenagers are able to screw their lives up by breaking bonds with parents, thus causing them life long socialization problems -- they have that power. And, guess what? I still have to pay child support!

Your son gave up parental rights to his daughter would you still have grandparents rights?

A grandparent's "rights" to grandchildren, if any, are accessed through their own child's legal relationship with the grandchild. A parent who gives up parental rights usually does so though a legal proceeding so the child can be legally adopted. Courts rarely allow a parent to sever their responsibility to their child unless there is another adult standing by to take over all the responsibilities of being a parent to the child. Therefore, if one parent's rights are voluntarily severed the grandparents have no link to the child if the child has been legally adopted by the custodial parent's spouse. Although the grandparents may want to continue to see the child it up to the child's parents to decide if seeing the grandparents is in their best interest. Grandparents rights, if any exist, are generally determined on a case by case basis through a court action. Although it may be extremely difficult to accept in some cases a child's parents should have the right to make such decisions without outside interference. See related question link provided below.

Yes. If the parent ever need financial help from the state, they will come after child support from the non-custodial parent first.

Can a child of 16 move away from grandparents who have custody and live other grandparents?

A 16-year-old cannot leave home without parental consent. If they do and the parents call the police (and I'm assuming they would) then the police will pick the child up and return him/her home. Despite the fact that you are family, it is possible that you (the grandparent) could be charged with something along the lines of harboring a runaway/interring with child custody/contributing to the delinquency of a minor/etc (the exact charges depending on where you live). The grandparent can petition the court for custody, but unless they are able to prove the parents to be unfit in some way...

Who can be stopped from seeing your child?

A judge can stop anyone from seeing your child including you. If a parent need to be kept away from a child the judge can see to that but there has to be good reasons to. Anyone else is up to the parents to decide. Some states have rights for grandparents to see their grandchild. But that is as far as it goes for relatives.

Is it illegal to not allow the children to see the other parent if they do not pay child support?

If there is a court order for visitation or custody it is illegal to not follow the court order. Child support, custody and visitation are 3 separate issues in court. Paying child support or not is not a reason to take away the child's right to see his/hers parent.

Can grandparents see their grandchildren even if the mom hasn t kept up on child support?

Whether she has kept up on the child support or not is irrelevant. Grandparents and other family members are only allowed to see the children if the parents allow them too. Grandparents involvement has nothing to do with visitation or child support granted by the court. It is entirely up to the parents. Parental visitation rights and child support are two separate issues in court so even if she did not temporarily have the money for child support that is separate from the court order for visitation. A child's right to see both parents is not based on their ability to pay child support.

Do grandparents have rights in California?

Yes, but they can not petition for visitation if the parents are married. You can file for visitation if: 1. the parents are living separately 2. a parent's whereabouts are unknown for a month or more 3. the child has been adopted by a stepparent or the child does not live with either parent. 4. if the grandparent is joined in that petition by one of the parents. The right to visitation is based on a pre-existing relationship that has "engendered a bond." The court considers what is in the best interest of the child and the parents' rights and authority to make decisions about the child. You can read more in the link below.
