The 4th Amendment does not in itself provide remedies, however, the Supreme Court has determined that the only way to enforce any of the Bill of Rights in criminal cases, is b…y use of the exclusionary rule. Therefore, any information that is obtained as a result of an unlawful search or seizure is excluded from evidence and cannot be used at trial. This will typically be determined by the judge prior to trial in a motion to suppress hearing.
