Best Answer

Abrogate means to abolish an agreement, especially an official contract, document, or treaty. Synonyms are annul, cancel, disavow, dissolve, or revoke.

An example would be the non-aggression treaties between Germany and the USSR during the early part of World War II, which Germany abrogated by attacking the Soviets in June, 1941.

How do you use the term common law in a sentence?

Common law is the kind of law developed in England and most English-speaking countries, where principles of law are developed on a case-by-case basis by judges. "The judge applied the common law as first set down in an eighteenth century trespass suit." The phrase can also be used as an adjective: "The statute abrogates common law rights which have existed for centuries." A special usage of it as an adjective is in the phrase "common-law marriage" which is used to mean a marriage which is informal or which has not been legally solemnized, and which, curiously, has nothing to do with the common law.

Can. 54 §1 A singular decree whose application is entrusted to an executor, has effect from the moment of execution; otherwise, from the moment when it is made known to the person on the authority of the one who issued it.

Under what circomstances would a judge take a name off of a deed to a property?

If the judge was shown a death certificate for another holder, a change of name perhaps, a signed agreement from the involved parties. Sometimes the property disappears. This is what judges do. A signed agreement IS a signed agreement. No one can be thrown off a signed agreement unless another agreement exists (by those parties), a law has been violated that abrogates the agreement, or the conditions specified in the agreement have changed.

Are rights absolute if not what are the reasonable limits to rights?

Rights are absolute and there are reasonable limits to rights. Rights are not law in a positive law sense, they are negative law and as such it is easier to discover what is not a right than what is. What is not a right is discovered when the action committed abrogates and derogates the rights of another. If this is the cause of an action then it is not a right. An example of an absolute right is the right to freely express ones opinion what is not a right is to libel or slander another as this action abrogates and derogates their rights. Someone who murders another has most certainly abrogated and derogated the right of another and that action so heinous in it's disregard for law and common law rights that the murderer has forfeited his rights to liberty as that person has demonstrated the very real threat posed to others. Everyone has the right to work and earn and enjoy the fruits of ones own labor unless the fruits of that labor are because of plunder. Plundering is an abrogation and derogation of someone or some peoples rights and such to plunder is not a right. The limits to rights are known by the damage those asserted rights have caused. As long as it is not injurious to others then it is most likely a right. If it is a right, it is absolutely so.
