Virginia does have a law against 'lewd and lascivious cohabitation' (Virginia Code 18.2-345) and a law against 'fornication' (Virginia Code 18.2-344). Now, whether or not these laws are actually enforced is an entirely different matter. It can be, and has been, argued that these types of laws are unconstitutional.
