In Pennsylvania, in order to fight extradition to another state, the defendant can contest the validity of the charge against him and petition the court for the issuance of a writ of habeas corpus. The Uniform Criminal Extradition Act provides some uniformity and, generally, the same legal requirements that are required for requests from other participating states apply to Pennsylvania requests as well.

All of the 50 states within the United States of America tend to respect, and cooperate with, each other in terms of extradition requests, depending upon the charge and upon legal standards being satisfactorily met. For such requests tend to be made over the serious, felony charges. But no state becomes involved once a country other than the U.S. has a role. For involvement of another country always is a federal concern.

All US states and territories honor each other's requests for extradition - there are no 'safe-haven' states - It is impossible to know with certainty whether a particular state will choose to extradite you for a particular offense, or not, there are simply too many variables. It may depend, in part, on the offense and the seriousness of it, and/or how badly they want you returned - most states WILL extradite for felony offenses and crimes of violence.

There are no "extradition" procedures within states.

The term extradition only applies to removing a prisoner state-to-state or country-to-country.

WITHIN the same state there is no necessity to prove the legality of a prisoner transfer because the laws are the same throughout the entire state.

For a person to be extradited from VA to PA the prosecution in the jurisdiction where the crime was committed must file for and acquire a Governors extradition warrant. Seldom are they rejected by the Governor of PA. When an extradition warrant is served the person either waives an extradition hearing or they are taken before a judge in the court where they were arrested and the court will hear testimony on whether to grant extradition or not. Seldom is extradition refused. Once the extradition is either waived or approved by the presiding judge either an officer from the jurisdiction will go to VA and take the person into custody for transport back to PA or the US Marshals office will transport the person.

Extradition laws are basically the same nationwide and require a governors warrant to extradition a person from state to state, within a state an extradition warrant is not required
