Women an ancient Rome were allowed to do almost anything they wanted except vote. Oh, there were laws supposedly restricting women's legal rights, but a woman could always get around them. For example, a woman legally had to have a male guardian. This was usually her father or husband, but not always. If the woman had neither she was free to choose her own guardian and change him at any time. There were also inheritance laws that restricted the amount a woman could inherit from her husband. But there was nothing to prevent the husband from signing over properties to his wife while he was alive.

There were two main form of marriage, cum manu, where the bride was placed under the legal control of the husband, and sine manu, where she remained under the legal control of her father. In the former the bride was legally "adopted" by her husband, became a member of his family, and assumed her inheritance rights within this family (she inherited from the husband, not the father).

A form of marriage cum manus was the process of coemptio. This was a fictitious sale of the bride to the husband conducted by a scales-holder and before at least five adult males who acted as witnesses. Legally, if the wife divorced, she became emancipated. The form of marriage cum manu acquired by usus was like a common-law marriage. It required that man and woman cohabitated for a year. After that, the woman became a wife by coming under the legal control of her husband and she was considered taken by the decree of yearly possession.
