It is always a federal offence for a convicted felon to posses a firearm, and in most states it is always illegal

Added: While SOME states DO have provisions for re-instating LIMITED firearm possession rights WITHIN THEIR STATE borders ONLY. You must research your states statutes CAREFULLY to determine if you reside in such a state.

The ruling federal statute is 18 USC, Sections 921 & 922.

To answer the question fully it would have to be known what state he is charged in and whether the felon was state convicted or federally convicted. IF it was a federal conviction the federal statute is VERY serious - - FEDERALLY CONVICTED FELONS - if you were convicted in FEDERAL COURT of a FEDERAL FELONY - it is a felony crime for a federally convicted felon to EVER own or possess a firearm. The U.S. Criminal Code, makes the penalty for illegal possession of a firearm a mandatory minimum of fifteen (15) years in prison in some cases (Title 18 U.S.C. sec 924(e)(1). At this time FEDERALLY convicted felons have no solution to their firearm disqualification. Congress has effectively eliminated the review of federally convicted felons' petitions for restoration of their firearms privileges, by denying funding for the purpose.

Several states have laws that prohibit a convicted felon from possessing a firearms, and those will vary from state to state. FEDERAL law provides for a fine, and imprisonment up to 5 years (no probation, and time cannot run concurrently with any other sentences) IF the firearm is a short barreled shotgun, machine gun, etc, the penalty is 10 years in prison.
