Yes - as more of the alcohol that is drank enters the bloodstream. IE - you drink three drinks real fast - get pulled over and blow a .09. Then you go to the station 30 minutes later and it is a .12 - happens all the time. However - it is the alcohol consumed that is doing it - nothing else. Sorry if this does not help your case.
