Is cancellation of debt taxable in New Jersey?

On February 15, 2010 I called the State of New Jersey and asked this specific question. I was directed to reference a court case in 2000, Weintraub vs The Director. The State representative summarized the case by saying that cancellation of debt income, whether it be business or personal (such as credit card debt cancellation received on a 1099-C form) is NOT taxable for New Jersey state purposes. It is however, taxable at the federal level.

If a Credit card company wrote off the debt and took a tax credit 4 full unpaid debt what legal rights does the credit card have in transferring rights to a collection agency?

Credit card companies win whether you paid or not. They write-off the credit card debt at the end of the year on their taxes, they also hedge their burden for increase risk by having insurance so they recover some of your losses from your default and they can sell their uncollectable debt to a third party (collection agencies). What rights do you have? The Fair Debt Collections Act. Your debt is with the original creditor (Credit Card Company) and not the collection agency any money you pay should be to the original creditor.

What is credit card debt cancellation?

Debt cancellation is a type of credit insurance service provided by the credit card company usually for a monthly fee. In most cases, the card company will wave the outstanding balance on your card in case of your death or long term illness. The fee charged is a fixed percentage of your monthly outstanding balance. Debt cancellation is usually sold in conjunction with debt suspension and is termed DCDS. Debt suspension is a similar type of service, but instead of canceling the outstanding debt, the monthly payments may be suspended for a short period of time such as one year in the case of involuntary unemployment or some other type of unexpected life events.

Do you pay US tax on credit card debt written off as a bad debt?

Yes. In the past few years the tax code has required companies to send tax forms like the 1099-C for cancellation of debts. This would be in just about any situation where you were allowed to pay less than you balance on a debt like credit card, automobile loans, mortgages, etc. Whether or not the entire amount is taxable depends on several factors.

If a lender purchases a debt and cancels the debt is there a time limit for a debt cancellation?

Cancellation of debts depending on individual circumstances can take a very lengthy time. When a debt is cancelled the creditor/collector is required to send a 1099C to the debtor and the IRS. A portion of the debt then becomes taxable income.
