Like most legal questions the answer is maybe. You don't say the state and in some state you might not. In most states if the pension was divided by a court order called a qualified domestic relations order (QDRO for short) you would have your interest in the retirement funds earned by your spouse just like your spouse would. Your remarriage would have no bearing on it. Depending on the order you may even be entitled to part of his death benefit even if he remarried. Generally your share of the spouses retirement is a fraction that is the product of 1/2 of his share earned during marriage. But it doesn't have to be. You can agree to just about anything. So read the order and consult a lawyer. You really should not depend on an answer on this site to base your decision on. Please consult an attorney.

That would depend on the settlement agreed at the time of her divorce from her ex husband. That is when these things are settled.
