According to Article 184(1) of the Constitution of the Islamic Republic of Pakistan, 1973 the Supreme Court of Pakistan, has, to the exclusion of every other court, original jurisdiction in any dispute between any two or more Governments. This Article explains that "Government" means the Federal Government and the Provincial Government. Clause (2) of Article 184 leaves no ambiguity in it that in exercise of the jurisdiction conferred on the Supreme Court of Pakistan by clause (1), the Supreme Court shall pronounce declaratory judgments only. Clause (3) of Article 184 is remedial and is conditioned by three prerequisites, namely, there is a question of public importance; such question involves enforcement of the Fundamental Rights ; and the Fundamental Right sought to be enforced is enforced by Ch.I, Part II of this Constitution.
Powers of the High Court are kept in tact under Article 199. Option is with the party to choose the forum.If it chooses the Supreme Court forum then power exercisable is subject to the limitation under Article 184 (3), i.e. that the element of public importance must be involved in the enforcement of Fundamental Right. The authorities in the shape of judicial precedents are available on this subject in PLD 1986SC 416 and PLD 1993 SC 473.
