The only requirement to have your maiden name restored is to contact the necessary government agencies (Social Security, DMV, voter registration, etc.) fill out a simple form and present the divorce decree and personal identifying documents (driver's license/state ID).

What is the procedure if a spouse has to change name after marriage?

When I divorced my ex I took my maiden name back. All I had to do is when file for divorce tell them you want the other name. When you go to court the judge might ask you why.. I told them I am not married to him after the divorce and feel I should not have to carry his name. The judge granted me my maiden name back. Good luck

Is a divorce considered legally changing your name.. Or can I still legally be my married name if I haven't gone to social security to change it...?

No, if you divorce it does not automatically count as a legal name change in the USA. You can still use your married name the rest of your life, although this is uncommon. Most divorcees change back to their maiden name after divorce.

Canadian divorce law requires a residency of one year in Canada (continuous) from one of the divorcees. This basically means if you want a divorce in Canada you (or your partner) must move back for a year before the government will grant a divorce.

How do you respond to someone who tells you they are changing back to their maiden name?

You don't have to say anything when someone tells you they are changing back to their maiden name. If they have divorced and want to change their name back to their own surname then it is up to the person doing it to enlighten you with information about the divorce and if she does not then you should just let the subject drop until she decides to talk about it.

Can a woman change her marital name back to her maiden name before a divorce is finalized?

Yes. Since a woman is not legally required to take her husband's name when they marry, she certainly isn't obligated to keep his name when they divorce. And, even though the divorce isn't yet final, you can still change your name back to your maiden name as long as you can afford the legal fees. In most jurisdictions you can request the right to resume your former name as part of the divorce proceeding. If possible, that right will be stated on the decree. That avoids unnecessary name change filings and expense.
