Answer

The answer for this is yes and no.

You must be able to perform the essential functions of the job. If you can, then you might be protected under the Americans with Disabilities Act.

Under the ADA, an employer must try to accommodate you by restructuring the job, or providing modified equipment, or modifying the work schedule etc. But, if any of these changes are quite expensive, so as to cause an undue hardship to the employer, then the employer does not have to go along with the ADA.

If you cannot perform any part of your previous job, then, unfortunately, you can be fired.

Answer

However, if you are fired because you are unable to perform the duties of your job, the company may have to pay for your work-related permenant disability. Get a lawyer or talk to the Dept. of Labor. Essentially, you suffered an injury at work that incapacitated you. (Most companies would rather put you back to work than pay the settlement.)

It depends on where (country or state) you work, the size of the company you work for, what their policies are and how you got hurt.

If you got hurt because you were not following required procedures, you may be fired - not because you got hurt, but because you did not follow required procedures. If your injury makes it impossible for you to perform your job, and an alternate that you can do is not available or you are unwilling to take it, you may also find yourself without employment, depending on local law.

The answer above is wrong. Employees cannot be fired BECAUSE of a workers comp claim, but can be fired for misconduct, poor performance, bad attendance even while off on lost time injury.

You CAN sue ... you will lose.

In most North American jurisdictions, this is not supposed to happen as most employers are covered by workers compensation insurance that provides benefits to the injured worker until an eventual return to work.

Which isn't to say it doesn't happen; and, that there aren't circumstances that warrant dismissal, such as deliberate malfeasance resulting in injury.

For the full answer to your question, you need to check with your local: workers compensation organization; labour relations board; union; and if possible a lawyer specializing in this type of law.

You are a plumber that hurt your right hand on the job you are getting workmens comp you also have a 2nd job as a part time janitor but you are still working your 2nd job is this legal?

Yes, this is completely legal. If you are hurt on a job you are entitled to workman's compensation as long as you are in some way hurt, even if you could continue to do the job. So yes, you can still work your second job. However if you are hurt in one job and cannot perform the other, whether you get workman's compensation for the injury or not will not make a difference if you get fired from your other job or not because you cannot do it.
