It depends on whether or not the other parent has joint LEGAL custody which is different from Physical custody. If you were married to the other parent and now divorced, you'll have to go back and check out what is ordered in your final settlement paperwork to find out. If you weren't married, was there any court case which determined custody between the two of you?
