- No, the father has to pay child support for both children. Of course the child that decides to live with him will be treated as he/she were when you were both married, but the child you have will still continue to receive child support by law!

Not sure how informed she is but if you go back to court at this point you will be ordered to pay child support "now" and you will probably never collect on the back child support. They certainly will not approve it merely so the parent can avoid paying child support. If that were allowed, people would be lined up to do it, and then a big portion of those children would end up having to be supported by the taxpayers.
