if she has primary custody, from the point of the filing date.
no
First, there is no such thing as an illegal mother. Any parent, male or female, single, married, divorced or separated, may receive child support.
A married couple would not be able to sue each other for child support if not separated or divorced. A judge would have no reason to sign an order for child support on these grounds.
yes
No, child support will be assessed from the time the order goes into effect. you can file for a support order prior to the divorce though.
If the father have visitation, shared custody or paying child support she will need his and the courts consent.
The mother must petition for child support. The mother must petition for child support. The mother must petition for child support. The mother must petition for child support.
if a divorced couple decides to get back together, which is great by the way, then whoever was receiving the child support has the oppurtunity to say it's over he doesnt need to pay it anymore. that person would have to go back to court before the judge to change it.
The wife and mother of the child should file a petition for divorce and child support immediately. The father will be required to provide financial support for his child. If the couple owns any property the court will see to its equitable division and perhaps allow some spousal support. She needs to consult with an attorney ASAP.The wife and mother of the child should file a petition for divorce and child support immediately. The assumption would be if the couple are residing together and the child lives with them then they are supporting said child. therefore a court order for child support would not be relevant nor possible.
Yes, they can. My parents are divorced. They got divorced when my mother was 8 months pregnant with me. My father paid child support until he got sick of it. But anyways, my mum kept me, and I'm still with her, 13 years, and same as my sister. :) Payment of child support does not, in itself, confer any right to visitation. However, the custodial parent must abide by any visitation orders. In many States, violation of a visitation order is a crime.
Child support is intended for the child's benefit, not the mother's.
