Yes, the father does get first claim, in order for the child to be adopted by someone else, he needs to give up his legal rights as a father to the child. If you fully give up the child for adoption, to him, then he can not make you pay child support, but if he takes custody only, then yes you may be instructed to pay child support. He does not need to adopt to get custody.
