To get Refugee status you must have fled you home in fear of "being persecuted for reasons of race, religion, nationality, membership of a particular social group, or political opinion" In addition you must not be able to return to your home country for the same reason. You then must register with the United Nations High commission on Refugee's. You may be selected for an interview for resettlement in the US if you are part of a population that the UNHCR and the US have decided to resettle or if you have a close relative already in America who has applied for you to come. You must pass several interviews and medical testing. If you do you may be resettled. It is totally up to the US if the take you as refugees do not have right to admittance. There are about 14 million refugees in the world the US has accepted 41,279 of them so far. It is a long shot to say the least. It is easier for people in fear to come to the U.S. on a temporary visa and apply for asylum. To gain asylum people must prove in a court of law that they will be in danger if the return home.

This procedure is based on the location of the intending immigrant. This is a very broad overview of this procedure.

  • Applying from the United States:
    • The US relative will file an I-130 Petition for their alien relative who is in the United States. Best practice is to complete the rest of the Green Card Application at the same time when the relative has immediate priority, and the following forms are required;
      • I-485, I-864, I-693, G-325A (for the US relative and for each intending immigrant), and a corresponding G-28 form when you use an Attorney to help you complete your forms. Additional forms may be filed currently to save US fees.
  • Applying from outside the United States:
    • The US relative will file an I-130 Petition for their alien relative who is not in the United States.
    • When the I-130 is approved by the department of state the intending immigrant has one year to apply for an Immigrant Visa.

A person has to apply for a visa before coming to a country within the EU to be able to stay in that country for a given time, usually for three months or shorter. The problem is that you can't apply for a visa if your aim is to seek asylum in that country.

Though, from 2009 Serbians can now go to a EU country without having to apply for a visa, so exceptions are sometimes made.
