Also,Consumer Credit Counseling service, in your state, will review your situation and give you a certificate. My understanding is that you must have the certificate to file. And, for anyone filing in Hawaii, the MAXIMUM amount of equity you have in your home, for a couple, is $40,200.00. So, if you owe $120K and your home would sell/list for $150K you have $30K in equity and you can keep your home. All forms are online with the US Bankruptcy court including the fee waiver (for the $299.00 filing fee) as well as the pay-in-installment form. Each State can be different so type in: Google.com Then type in: bankruptcy laws in ________ United States You will get a lot of info off these sites that will help you out. Please, if there is anyway you can pay off your creditors please do so. Phone each company and meet with them and come to some agreement. If you appear to be honest and trying to keep up your credit rating most companies will give you an edge as they would rather have your money. If you go into personal bankruptcy you will have to wait up to 7 years (varies in different States) to get credit again. 7 years is a long time. Good luck Marcy

You need to get the yellow pages and look in, ATTORNEYS, look for one that specializes in bankruptcy.In some states it may require that you have an attorney in order to file bankruptcy. In the state of Oklahoma you are not required to have one. My advice is for you to contact the court house in which you plan to file and ask them if you are required to have an attorney. The best approach is to seek legal advice but you can find most , if not all, of the forms at a local office supply store. A person will also need to gather all of the names of collectors and companies along with the amount owed and addresses before filing. There are fees for filing which are different from state to state and you can also find this out through the court.

If you have to ask to start.....you need professional help doing so. Filing is one small step in a very complex process, with lots of ongoing requirements, that need to be handled correctly or risk not only having a bad result, but doing something considered criminal (deceiving the court). Get an attorney...many of your creditors will!

There are several ways to file bankruptcy. You can use an attorney or you can use a document preparation company. They both have their ups and downs. Financially the preparer is less expensive..normally less than $1000 to file, where as an attorney can be up to $4k. here is a website that might help

You should at least consult with a bankruptcy attorney. Most BK lawyers offer a free initial consultation. Don't hire one unless you feel comfortable. If you wish to file your own, you may be doing it at your own peril.

Some BKs are relatively straight forward and you can get through it. Most are complicated. Whether you use an attorney or not, be sure and consult with a qualified attorney.

The same as in regular court. You have to look up the Rules of Federal Proceedure regarding Motions and the Bankruptcy Courts local Rules. Those rules tell how to file a motion and what to include. Some times you can search the Court forms and find a sample motion. Motions are required to have 28 to 30 days notice. Basically write it up, include a declaration and proof of service and call the Judges clerk to schedule a day 28 to 30 days away. This is just basic information, but you need to keep asking question and check your rules. There are books you can buy. Federal Rules of Proceedure 9014 talks about motions and responses.
