Well mainly anyone the Government can choose if they want them to come in or not. ie. if they know they use to be from a terrorist group than they may not want to let them in

Can you apply for Refugee status in Canada if you are in States already?

Yes, you can "apply" for refugee status in Canada. I gather your "real question" is "what are your chances for becoming accepted in Canada as a Refugee and have this application converted to permanent residency status / "landed immigrant". Canada accepts about 11% refugees each year - percentage of 100% of applications for immigration to Canada. The balance are made up of independent, family and business applicants (open a business in Canada). More info can be found on the Immigration Canada website on this. Part of this issue is whoever is applying should have legal status in some country, and not be stateless.(no country to call home). If you are "stateless" and can't get travel documents from your home country, or your native country embassy or consulate, then this makes this more difficult. Travel documents can include a passport, for example. Statelessness, in my opinion, I'm not a lawyer and have had to familiarize myself with this as an advocate, can happen if for example, your country was part of the old Soviet bloc countries, and has now gone independent - and the new country doesn't consider you a citizen - you've been gone too long, etc. If you don't have status in the US, or lost a bid for permanent status in the US, then the US is not going to provide you with travel documents. Canada needs travel documents for you to enter to stay. Travel documents say you can go back to the other country (original country, or the US, for example,) if Canada doesn't accept you. Immigration Canada is in the process of overhauling / reviewing its immigration processes and background checking process. Sadly, there is an international sort of 'quiet agreement' that if you are refused status in one country as a refugee, then you will automatically be refused in the other countries that are part of this 'agreement'. ............. Third party countries: Example, if your parents, say, were Nigerian and for the sake of this example you happened to be born in Ireland as your parents were there on business/ vacation, etc and you were born in a different country from your parents' citizenship. Later, if let's say you need to leave Nigeria due to being in danger, you will find it hard to claim refugee status in the States or Canada (possibly elsewhere) unless you are also in danger - and can prove it- if you go to Ireland. You may never have lived in Ireland except for the days or early month(s) after your birth, but in the eyes of most countries, you have citizenship "there" and will be expected to go back to your birth country (Ireland). So for anyone thinking to have their child born in a country other than their home country, this plan can backfire later - or not - depending on what happens later. One case I was involved in was a daughter of a political leader of an African nation - see Ireland above - try as we might, there was no way to create an immigration / refugee case for her to stay in the US. What a mess it was! If you are thinking to claim refugee status - please try to bring all your documents with you, such as passports, birth certificates, resume, employment reference letters, school and university transcripts, etc. If you can get a financial sponsor, your case is stronger. Try family members, churches, ethnic groups, etc. Bring anything you can think of that will show you are in danger to stay in your home country. Hope this helps! For refugee claimants, personally, I would suggest you use a lawyer vs. a visa processor. You get one shot at refugee application - make it a strong one!
