The concept of common law marriage is a difficult one. In the USA the legal status varies from state to state, with most not recognising it. Where they are recognised divorce is usually necessary before a subsequent marriage can be entered into. In England there is no legal status to common law marriage, although the situation is slightly different in Scotland. In short, marriage to someone else is probably legal, but the advice of an attorney/solicitor would be a wise thing to take.

I assume you are saying that one wife filed for divorce and you have married someone else? If the divorce from the first wife has not been finalized and granted by the courts, you are still legally married to the first one and YOU are the bigamist.
It sounds as if you are referring to common law marriage. That doesn't exist in most jurisdictions. Generally, in order to be legally married a couple must obtain a valid marriage license in their particular jurisdiction and have their marriage solemnized by some official who is allowed to perform marriages in that jurisdiction.
The first means of finding out if someone has ever been married is to ask them. If you can't do that, then you have to search the marriage records of the places where that person lived. Modern marriage records may be partially closed for privacy reasons. Older records may be incomplete, poorly indexed, etc. Or you may simply not look in the right place. So you may have to be satisfied with concluding that you could not find a record of marriage.
"A proverbial fifth marriage" refers to someone who has been married multiple times. The phrase is often used humorously to convey the idea of someone who has had numerous failed marriages and may be seen as unlucky in love.
