That being said, there are cases where criminal charges can be put upon you in the event of non-payment.

  • If you fraudulently obtained a loan or incurred a debt, you could be charged with criminal fraud.
  • In some states, if you purposefully attempt to hide a vehicle from repossession or interfere with recovery, you could be charged with Hindering a Lender in the Recovery of collateral (comparable to GTA--not the game).

That being said, the creditor is not interested in your incarceration. The creditor is interested in the money or the collateral, and more interested in the money. They have various and sundry means of recovering on a debt.

No, not paying your debts is not a crime, it is considered a civil matter and the lender can sue the borrower in civil court and receive a judgment to use against property or income belonging to the debtor to collect the debt owed.

Except in the state of Arizona. In AZ you can be charged with either a misdemeanor or felony for not paying back a payday loan. In that state the loan centers got around the civil litigation by being declared banks, so in AZ you would be charged with Bank Fraud.

Now if there is fraud involved in this in anyway, yes, you will go to jail. Just call your student loan provider and tell them you are having hardship and they will forego the loan for a couple years until you are financially stable again.
