Yes, you can relinquish your parental rights, however, if you are doing so to avoid payment of child support, most courts will not approve the relinquishment. Ultimately, the court will still have to say that it is in the best interest of the child. That normally will not be done unless there is someone willing and able to adopt in your place.

Relinquishing parental rights normally involves a judical process and can not be simply decided by two parents on their own. The reason is that both parents have an obligation to support their minor child. Public policy dictates that for the protection of the child relinquishment of rights can not be a private matter. It is fairly common for biological parents, most often fathers, to give up rights in a child through an adoption, i.e. mom was a single mother, now married to a man willing to assume the legal obligations of fatherhood for her children. The best answer to your question is that it and its self attempting to give up parental rights is not illegal and should not land you in jail. Failing to support child support may have serious legal ramifications, incluidng going to jail on a contempt citation if that what it takes to get the parent to pay arrearages in support.

Yes. You can give up custody. You can give the other parent or person full legal custody through a stipulated agreement if they agree to it.
