You can not remarry until your divorce is final, signed and sealed. There might also be a waiting period before you can remarry in your state. Be sure to find out before you get hitched again.

How long is divorce paperwork kept on file in California?

Once everything is filed with the court, a California divorce takes about six months before you are divorced. If the divorcing couple is living together, a divorce is filed in the California Superior Court in the county of residence of either spouse. One spouse must have lived in California for at least 6 months prior to the divorce and in the specific county for at least 3 months.

If you live in California can you get a divorce in Texas?

To file in Texas, one of you must have lived in Texas for the last 6 months, and in the county where it's filed for at least 90 days before the Petition was filed. So, if you live in California but your spouse is in Texas, you can file where your spouse lives.

Would a wife get half of what you have in a divorce if they are married in Palestine but lived 9years in New york?

If you live in New York and that's where the divorce is filed for, then it will depend on what New York's community property laws are, not Palestine's.

If married in France can you divorce in ny?

Yes, you can divorce in New York state no matter where you married, providing that at least one spouse meets the residency requirements for divorce in New York State. Currently, you must live in NY state for 1 full year before filing for divorce. If your spouse has never lived in New York state and the causes of the divorce did not occur in New York state and you were married elsewhere, then you must wait 2 full years.

Is a wife entitled to alimony if the couple have lived apart for 8 years and a dissolution petition was signed but not filed?

Maybe. If a legal separation or divorce decree was not granted by the court then the couple is still married. Spousal maintenance (alimony) and other issues cannot be addressed until a valid dissolution of marriage petition is filed in the appropriate state court in the county where the filing spouse resides.

Is it considered adultery if my spouse and I have lived apart for over a year?

I assume you are speaking of extramarital sex. Adultery occurs when a married person has sexual relations with a person who is not their spouse. You are married until you obtain a divorce.I assume you are speaking of extramarital sex. Adultery occurs when a married person has sexual relations with a person who is not their spouse. How can you find out if your husband got a divorce. I found a marriage record but no divorce record?

You could check the county divorce records in any jurisdiction where the couple lived. You could also check the official state vital records office in the state capital. If you don't find any evidence of divorce then ask your husband where the decree was entered. If there was no divorce then you are not legally married and his wife would inherit his property as the surviving spouse if he died. You could check the county divorce records in any jurisdiction where the couple lived. What if you don't know the courthouse that your divorce papers were filed at how can I find out if it has been finalized?

Who filed them? Ask that person. They had to be filed in the family, divorce or probate court (whatever it is called in your state) for the county you or the other party or both of you lived in at the time (or for the previous year or so, depending on state law again).

When a couple divorces before a workmens compensation settlement is paid is the spouse entitled to any of that claim due to marital property?

It is possible if the claim was filed before the divorce and the couple lived in a community property state, the ex-spouse has claim to a portion of the settlement. In other states it would depend upon the terms that were stated in the dissolution petition.
