I don't see how. I'm amazed you still physically have the car. I guess if your finance company is just being nice you could try writing to them and see if they'd send you the title.

Can you sell the car after it is charge off?

If you have a clear title, then you can sell it. I don't know why a finance company would charge the car off and give you the title, but if through some miracle that did happen, then you could sell it.

You are filing ch 7 and they want a car you already sold?

If it was secured by the loan you didn't have title to sell. If you did sell it, better be prepared for a heap of legal problems from the buyer, because he didn't get clear title....and finally if you got the money...where is it?

Can you sell your car before the loan is paid off?

Yes. Be sure the buyer knows that the title is not free and clear. When they pay you, pay off the loan, wait for the title, and sign it over to the buyer. Don't hand over the keys until they have the title. You can give them a bill of sale as a receipt that they paid, but that is all they get until the title arrives. You are liable for their injury if they get into an accident before you sign the title over to them. You will have to pay off the loan or have the loan assumed. You wont be able to sign over the title since the loan company holds it until you have paid off the loan. If the loan was a personal loan you have the right to sell the vehicle whenever you like however you will still need to make payments or settle the outstanding balance. If the loan was secured against the vehicle you will nedd to arrange with the finance company to settle the balance before tittle is handed over.

If you actually own the vehicle free and clear (no outstanding loan) you will not lose it, but you may be ordered to sell it (liquidate it) in order to pay off your creditors.

How can you sell a car that you owe more on than what it's worth in other words where does the balance you owe transfer to?

If you car is finance, there is a lien against it by the bank or loan company. This Lien will have to be removed, which means that the balance owed on the vehicle has to be paid in full in order to get a clear title to sell the car. You are "upside-down" on your car loan ... where you owe more than it is worth or can be sold for. You need the permission of the loan company to sell the car ... you can't sell it without the title, and the company that holds the title (aka pink slip) also holds the note for the loan that you are paying back monthly. You will need to pay the balance of the loan regardless of what price you could sell it for. In this case, you will be handing over a large sum of money just to sell the car ... best thing to do is just keep it.
