Generally, when one is eligible to receive unemployment benefits if one is unemployed through no fault of his own -- this contemplates the possibilities of a lay-off, getting downsized, or disabled. A company closing is something an employee cannot control -- however, if he resigns, then he is unemployed because of his own choice. An exception to this would be constructive dismissal.

It depends. If you are retiring, you cannot collect unemployment because you do not intend to return to the work force. If you quit, it depends on the reason you quit and whether the state allows the conditions for which you did so.

This depends on why your employer let you go. Unemployment insurance is a program that provides workers who lost their jobs with a weekly income during times of unemployment. The program is run and funded by both state and federal taxes paid by employers. To qualify for unemployment insurance benefits, a worker must:

* Have worked a certain number of weeks during the year

* Have earned a certain amount of money in the past year

* Be actively looking for work

* Be unemployed through no fault of his own

If you left one job for another job, when were you unemployed? If you simply take some time off between the two jobs, no, you don't. If you quit one job to look for another one, the rules will vary according to the state.

Not as you put your question. If you just quit or resigned for unjustifiable reasons that were your choice or fault, you would not be eligible.

Can you collect unemployment if you are part time in Wisconsin?

Answer:Sometimes with a family, people are forced into part time work and are unable to make ends meet. Most states allow you to collect unemployment if working part time, under certain circumstances. Some may have you collect on a former employer if you are still in the benefit year and you had claimed unemployment before your present job. Much depends on the state you work in and their criteria. Contact your state unemployment office for clarification.

If a person collected unemployment 8 years ago and then gets laid off again are they eligible to collect again?

Your collecting unemployment before has no bearing on your ability to do so now. All that matters is if you qualify under the current conditions and with your latest employer(s)

Can you collect unemployment if you live in Michigan and got laid off in Indiana?

According to the Michigan Employment Security Act, you only qualify for unemployment if you quit your job because of an action (or lack thereof) of your employer that a reasonable person would be unable to tolerate. You must first inform your employer of your concern and give them the opportunity to make changes before you quit. You have nothing to lose by filing for unemployment benefits and should do so, providing all pertinent information and documentation that you have, allowing the agency to decide whether you are eligible.

If you haven't been paid for work in 6-8 weeks can you quit and still receive unemployment benefits?

You have a pretty good argument here. In addition to meeting other qualifying requirements, you can only collect unemployment if you did not get fired/had no part in losing your job. Not being paid is a reason to leave a job and therefore you have a chance for unemployment based on the fact that your employer is essentially forcing you to lose your job. As with most things, it is always best to communicate with your employer before doing something like quitting. Since it is the employer that will need to sign off on your unemployment application (and the circumstances of the end of your employment) I would suggest discussing the matter with him first.

How long can an employer have a grievance against unemployment benefits in New York before the person begins being paid his or her benefits again?

A person typically has to stay with a company for a specified period of time before earning the full pension. The employee can get their share out but the employer share will remain with the company upon resignation.

Can you terminate an employee before the end of their 90 day probation period and deny them unemployment compensation?

The employer neither denies nor approves Unemployment Compensation.Another answer:The above answer is correct in that the state's unemployment agency decides whether or not you get your benefits. However, your question is valid where the employer, by shortening your working period, may actually make you ineligible for the state's requirement. It would depend on the worker's employment agreement, the employer's record of similar actions (possible violations of law), and your own state's ruling in these matters. Check these questions out with your unemployment office. Good point!

Can you collect unemployment if you refuse a job offer?

If you turned down the other job then it's doubtful. To collect unemployment you need to show willing to get back into work, turning down a job puts you in a bad position when it comes to claiming benefits. There's usually a time-out period before you can start claiming again.
