Unfortunately, if family services has become involved, he may have to fight for custody. Either way, he has to petition the court. see related link
Yes, until they are removed by the courts.
a very big chance
She can't. She might be able to persuade a court to do so. The child support would, of course, cease (and in fact the father might be able to then claim child support from the mother).
Judges do give custody to fathers, but not always by what you say. You have to have proof that the mother is not fit to take care of the child/children. Example: drug addict, mentally not with it, financially unstable to the point where they don't have a secure home..ect
Unless he's abusive, an alcoholic, a repeat criminal, a drug addict, doesn't provide for his children or has a partner that is either of these - you can't. The father has the same every right to access the child as the mother.
How can you best gain custody of your children who are currently living with their mother and the mother is a drug dealer
He was a drug addict
As opposed to a violent mother? If he's cleaned up his act, yes.
Regardless of what is said about them Lawyers are very useful people. If you're sure the mother of your child is a drug addict, you can have your lawyer advise OCS of this demanding they put in frequent welfare checks on the children and mother and make recommendations that the child be put into the custody of another (clean and sober) member of the family or even into foster care. An other method is have family check in with the mother and your children frequently (if allowed) with the admonition to call the police at the first and every sign of drug or alcohol abuse. Or to at least talk her into letting the kids "stay the night" when she's on a runner. It's very important to be a friend of this addict so that she'll know it's concern and not vengeance the family is doing this over. Concern for her especially. Emphasize you want your kids away from the dope, not their mother.
yes crack cocaine
No. It depends on a lot of factors. In most situations, the mother gets custody of the child. If the mother is a felon of a drug addict, the child will probably go with the father. Money is rarely taken into consideration unless the mother cannot support the child with her income.
Drug addict is the correct spelling. A drug addict suffers from drug addiction.
Sadly, many times a vile wreckless drug addict can get joint custody of a child if the courts are not aware of the drug problems. If the child is in danger, speak to an attorney to get the custody order changed.
