If your spouse is on the title and/or mortgage with you, then you may refinance in your name only and have them removed from title BUT only with their consent. They have to also be at the closing. Thanks Edward David American Home Loans 866-281-5363 Ext. 1020

You will have to refinance your loan in order to get his name off. The loan now has both of your names on it because you both appied at the same time. This mortgage has to be paid off in order to remove the ex-spouse. That means you will have to apply for a new mortgage in your name only.

Yes. The judge can order the spouse who is keeping the vehicle to refinance it in their name only.
The estate of the deceased is responsible for the debts. The spouse is going to have to pay the debt as a beneficiary of the home purchased by the spouse.

Your best bet mam, is to make sure that you are not a co-signer on any debts with your husband. If you are an authorized user on any accounts, like a credit card for example, contact the creditor and have them remove you from that account as the authorized user. This will save you alot of grief, and credit problems. If it is other accounts like a home loan, car loan, etc.. My only suggestion is refinance the home (if possible), and only include yourself on the Title (Not the loan application). This will keep you clear of any foreclosures in the near future, and he cannot sell nor refinance that home without your agreement. If you a co-signer of a car loan then try to refinance that vehicle in his name only. Good Luck with this process.
You can do either, but some credit sources place limitations on the minimum amounts / minimum percentages that they will loan.
The only options are for one of the borrowers to refinance the home in their name only or for the property to be sold.
