As long as it's switched on - any mobile phone can be tracked to within a 3 metre square location. The mobile network always knows the physical location of each active handset - so that it can route calls, texts etc to the phone at all times. The handset is always in communication with the three nearest phone-masts, and the network's computer system can therefore show where each handset is.

No, it can only be traced when on but if worried, take the battery out. Mind you, if you have not done anything wrong then you should not be worried about the phone being traced by the authorities, they would soon get bored listening to you and Aunt Maud and how the garden is coming along.
