You can if you can prove it. You can, but there is a common phrase "You cannot sue a man of straw", which simply means that you cannot sue someone for something they do not have, if the person honestly doesn't have the means to repay the loan then you will get nothing from attempting to sue the.

You would also need to provide some sort of proof that a loan was actually made, although what counts is very much subject to debate amongst judges.
