The creditor would need to obtain a lawsuit judgment from the Texas court before wage garnishment would be allowed.

Texas only allows garnishment of wages when there are no other means for a judgment creditor to collect a debt owed.

If a judgment has already been entered against the debtor in a different state, the judgment creditor can place a "foreign" judgment lien against property owned by the debtor.

Texas allows bank account levy by a creditor judgment. Wage garnishment is only allowed if the creditor does not have any other means of executing the judgment.

In Texas can your bank account be garnished?

Yes, Texas is a community property state therefore all joint marital accounts can be garnished regardless of which spouse incurred the debt. Accounts held by persons not married, places the burden of proof as to the percentage of funds belonging to non-debtor account holder and would therefore be exempt from judgment levy.

Can a creditor levy your bank account in Texas and how do they find your bank account?

Yes your bank account can be levied for a credit card debt in texas. They CANNOT garnish your wages but they can levy your bank account if they sue you and get a default judgement. I found this out the hard way. My husband had stopped paying on a credit card in 2006 and we received a notice 12/2009 that they were suing him but was not aware of what they could really do besides put it on his credit. They froze every account with his name and social attached to it.

Can wages be garnished in Texas for unsecured debt?

Texas has a rather complicated garnishment code in that wage garnishment is only allowed if the judgment creditor has no other means of executing the judgment for monies owed. This is somewhat misleading as Texas does allow bank account levy, so all the creditor needs to do is enforce the judgment against the debtor's account. FYI, even joint marital accounts are subject to levy although only one spouse may be named on the judgment writ. Accounts held jointly by persons not married can be levied to the extent of the funds belonging to the debtor.

Can a debtor's wages or bank account be garnished for credit card debt.?

Yes. In any state, a credit grantor may garnish wages, but only after receiving a judgment in their favor from the court. In other words, they'd have to sue you, win and be granted an order for the garnishment. * Texas only allows wage garnishment if there is no other method for the creditor to execute the judgment. For example if the debtor does not have a bank account that can be levied, other non exempt property that can be seized and sold or real property for which a lien can be placed.
