You can visit the court in person and ask to speak with an advocate. You can file a petition for a court ordered DNA test. The court will assist you and the mother cannot refuse or she will be in contempt of a court order. You should act immediately.

Yes, he can have the court order a paternity test.

AnswerYes. Just like the fathers who refuse to pay child support based upon not knowing if the baby is his, mothers can be court ordered to bring their children in for a paternity test. If its something you dont want to do, let the father talk all he wants but wait for the court to tell you that you have to bring your child in. AnswerThe biological father can request the court to order the mother to submit herself and the child to a paternity test. But, there is no guarantee that the court will grant the petition. For example, if the mother was married at the time the child was conceived, the law presumes the woman's husband to be the father and will not allow another individual to interfere in the marriage or order testing unless the mother voluntarily submits.

Usually not, if a court ordered test has already been performed. However the father can obtain a paternity test from another source and challenge the findings of the court ordered test based on the same. Otherwise, yes, the father may petition the court for a paternity test.

No. There is only one reliable way to get a paternity test today before the child is born and that is through a amniocentesis. That means a needle will be pushed through the skin, tissue, uterus wall and into the sack where the baby is to test the fluid there. This is risky and can cause labor to start. When they allow to test paternity this way it is only if there are other reasons for such a procedure, like checking for illnesses. No judge will force a woman go through a risky procedure that can make her lose the baby.

Yes he can, and they very often do. The courts will interpret this as an attempt by the father to prove he is not the father.

Can you file for a paternity test if the father wants to be involved in the childs life if it turns out to be that the child is his. But the mother says she does not want the father around?

After the baby is born the father can go to court and request a paternity test. If the test confirms the father's paternity he can request custody and a visitation order and the court will establish a child support order. The mother cannot refuse to obey the court orders that establish the father's rights. If she does, she could eventually lose custody.

How soon can a paternity test be preformed?

Paternity test can be performed with newborn baby and even it can be done on unborn babies through mother's amniotic fluid but its risky process.

You need not wait for birth for a paternity test. One can be done while the baby is still in utero (in the womb or inside its mother).

If court ordered can you refuse to take a paternity test if you were not informed of your right to refuse one?

Believe me, if you were ordered by the court to take a paternity test, there is no "right" to refuse it. The alternative to "refusing" the courts order is to suffer the consequences of a charge of "Contempt of Court."

Can you refuse paternity?

If the test is ordered through the courts, you can actually go to jail for refusing to establish paternity. So, no.

You want a DNA test to prove im the dad but the mother of child wont have one?

A DNA test is used in situations when paternity is contested. That is if someone gets a lady pregnant and claims it is not his baby, the mother can insist on a DNA test for purposes of child support. If the mother is the biological mother of the child, the test will be stupid since she had the baby to begin with

If the biological mother refuses to go for a paternity test?

If you are a legal guardian of the child then you can take the child and go get a paternity test yourself.

The assumption here is that a husband, in the process of a divorce, has filed for custody and the mother is countering it by claiming that he is not the father. She can do this.
