In general, a charge off alone does not give a collection agency the right to place a lien on your house. However, if the debt is taken to court and a judgment is obtained against you, then the collection agency may be able to place a lien on your property as a way to secure payment. Each state's laws regarding liens and debt collection can vary, so it's important to consult with a legal professional for advice specific to your situation.
Yes. A charge off simply charges off the debt with the original creditor but just because it is charged off the creditor still can take action to collect on the debt.
Sorry but yes they can. In the original contract there was a clause about what actions could be taken if you defaulted on the agreement and one of those actions is that the account could be turned over to a collection agency. So, even though you didn't directly enter into a contract with the collection agency you agreed to abide by the contract and the collection agency now legally owns the contract. It works the same way as when you purchase a house. At some point the original lender on a house may sell the contract and you will be paying a different lender.
That's the original creditor's "in house" collection department. They are NOT subject to the FDCPA as are 3rd party collection agencys.
Yes, a collection agency can make a house visit or visit you at work if they cannot reach you by phone and their letters are going unanswered. Personal visits are one of the most effective ways to get paid.
No, if you ever hear of it, it is just a scare tactic that some debt collection agencies use. The only agency that can foreclose on your house is the bank or lending institution that holds your mortgage. And they can only foreclose if you are way behind in your payments. No, if you ever hear of it, it is just a scare tactic that some debt collection agencies use. As far as I am aware (and I am currently in this situation), no. However, a collection agency automatically adds on additional charges for debt collection. It may be worthy to note my situation here: I was sent to collections on an (illegitimate) unpaid move-out charge by Harvard House Apartments. What I noticed after checking my credit was that the bureau remarked this particular collection will be removed in Nov. 2010, which is only 2 years 8 months. I was researching the specifics that a move-out charge is associated with (oral, written, promissory contract, etc...) since they each have their own statute of limitations. During that research I came across the question this person asked and thought it might pertain. Hope it helps!
It could. If you had a withhold of adjudication on the charge I suggest you have your charge sealed or expunged.
125/hour or more It does depend heavily on what the agency is doing. Larger agencies typically charge more because they have in-house resources for deliverables. In-house resources can streamline operations and make it easier for the client. They also attract top talent. The highest per hour rate I have witnessed is $375 per hour.
An in-house agency is an agency responsible within the advertiser's organization for all advertising activities.
any court house by giving your name DL number ..you call the collection agency they sent it over too.. haha

There is no special rule that says why should businesses use collection agencies. One of the most essential activities of a business is dealing with the accounts payable and there is going to be other business or consumers that will not pay on time, for business accounts that are delinquent 60, 90, 120 or more days, represent a tremendous lost. When a business goes after their delinquent account (past due accounts) may represent an enormous effort and resources to collect that account, some times business have in-house collection department, some business mix in-house with a third party collection agency. When collecting business debt a commercial collection agency usually is needed. So, this is up to the business, if they want to collect themselves or via a third party collection agency
